1. Who we are. This website and the ShopTrend service are operated by Akaydigital LLC, 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, USA ("we"). Contact: info@akaydigital.net. By creating an account, subscribing or using the service you agree to these terms.

2. The service. ShopTrend is subscription software (software as a service) for online sellers. It lets you follow competitor stores, their new products, price changes and ads, and shows estimates of store sales and revenue as ranges with a confidence level and a data date. It is software only; we do not provide consulting, managed services or physical goods. Plans, limits and prices are listed on the pricing page. Features marked "in testing" or "early access" may change.

3. Plans, trial and prices. There is a free plan with no time limit, and paid plans (Starter, Pro and Agency) billed monthly or yearly. Paid plans come with a 7-day free trial, once per account: you add a payment method when the trial starts, and the first payment is taken when the trial ends unless you cancel before. Prices are in US dollars in every country and are shown on the pricing page before you pay; tax such as VAT, GST or sales tax is calculated from your location and added at checkout where it applies. If you have a discount code, you enter it at checkout. We may change a price for future billing periods; we will tell you before the change reaches you, and the price you agreed to stays in force for the period you have already paid for.

4. Payments. Akaydigital LLC is the seller of the service and issues your invoice. Payments are processed by our payment processor Stripe, Inc. and its affiliates ("Stripe"). Stripe handles your card details; we never see or store your full card number. Invoices and receipts are sent to your account email and are available in the billing portal of your account.

5. Subscription, renewal and cancellation. Paid plans renew automatically at the end of each billing period (monthly or yearly) at the price shown when you subscribed, until you cancel. You can cancel at any time in the billing portal of your account or by writing to us. Cancellation takes effect at the end of the billing period you have paid for: it stops the next renewal, and you keep access until that date. You can change plans in the same portal. If a renewal payment fails, we retry it for a short time and your access continues meanwhile; if it still cannot be collected, the subscription ends. After a paid plan ends, your account moves to the free plan and the limits of that plan apply.

6. Refunds and right of withdrawal. Because access to the digital service begins as soon as you subscribe, payments are non-refundable. The exceptions, including the 14-day right of withdrawal for consumers in the EU, EEA and UK and billing mistakes, are set out in the refund policy.

7. Your account and acceptable use. Keep your login details safe; you are responsible for activity under your account, and one paid seat is for one person unless your plan allows more users. Do not attack, overload or probe the service, do not resell or republish its data in bulk, do not share access beyond your plan, and do not use automated means beyond the API and export features your plan includes. We may suspend an account that breaks these rules or the law, and we will refund any period you paid for but could not use because of a suspension that was our mistake.

8. Information and estimates. Any figure the service shows about stores, sales or revenue is an estimate shown as a range, derived from publicly available information and official sources. It is not a guarantee, financial advice or a statement about any specific business. Third-party names that may appear belong to their owners; we are not affiliated with Shopify, Meta, TikTok or Google.

9. Intellectual property. The service, its text, design and name belong to us or our licensors. You receive a personal, non-transferable right to use the service for your own business while your plan is active. Your own data stays yours.

10. No warranty, limited liability. The service is provided "as is" and "as available". To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing here limits rights you have under mandatory consumer law.

11. Governing law. The laws of the State of New Mexico, USA, apply, and the courts of Bernalillo County, NM have jurisdiction, without removing mandatory consumer protections of your country of residence.

12. Changes. We may update these terms; the date above shows the latest version. If a change is important, we will tell account holders by email before it applies to them.
